COMMERCIAL TERM

1. Raw land using fee

- USD 0/sqm (An Phat Complex has paid one-off payment)

2. Payment term and deposit

- Deposit: 20% of contract value

- Lease agreement signing: 40% of contract value

- Ground handover: 25% of contract value

- Land Use Rights Certificate Handover: 15% of contract value

3. Management fee

- USD 0.05/sqm/month (fees are calculated by entire land area). The fee will be charged on the 10th January every year

4. Electricity fee

The monthly payment at the present Vietnam Electricity (EVN) requests the payment divided into 03 (three) times on 5th, 15th, 25th.

Current unit price (VAT excluded) for reference as follow:

- Normal hours: VND 1,452/kwh (approx. USD 0.062/kwh) (From 4h00 to 9h30, 11h30 to 17h, 20h to 22h from Monday to Saturday, and 4h00 to 22h00 Sunday)

- Peak hours: VND 2,673/kwh (approx. USD 0.115/kwh) (From 9h30 to 11h30, 17h to 20h from Monday to Saturday)

- Off-peak hours: VND 918/kwh (approx. USD 0.04/kwh) (From 22h00 to 4h00 the day after, applied to 7 days a week)

5. Water fee

Monthly payment on the 10th of the following month, in December, payment is made on December 31. Water price is quoted as unit price of water supplier.

- Current unit price: VND 14,500 /m3 (approx. USD 0.62/m3)

6. Waste water treatment fee

Wastewater amount is calculated as 80% of total clean water used in the same period (indicated in Water Supply Meter). Monthly payment on the 10th of the following month, in December, payment is made on December 31.

- Current unit price: 18,500 VND/ m3 (USD 0.8/m3) for B-type wastewater.
